ICEBUM Floating Bar Terms of Service

Welcome to ICEBUM’s Floating Bar. These Terms of Service govern your purchase and use of ICEBUM products including the floating bar and related accessories. By purchasing or using the Floating Bar, you agree to be bound by these Terms. Please read them carefully before use.
1. Use of the Floating Bar
1.1 Intended Use and Safety
The Floating Bar is designed for recreational use on bodies of water including pools, lakes, and rivers for the purpose of keeping beverages and items cool while floating. Users are responsible for ensuring safe conditions at all times. Coast Guard approved personal flotation devices should be worn at all times when using the Floating Bar on open water.
1.2 Beverage Use
If the Floating Bar is used to store beverages, users are responsible for following all applicable food safety and beverage storage guidelines. ICEBUM does not provide guidance on beverage consumption or storage practices beyond the intended use of the product.
2. Orders and Payments
2.1 Order Acceptance
Submission of an order does not constitute acceptance. ICEBUM reserves the right to refuse or cancel any order at its discretion including but not limited to product availability, quantity limits, or pricing errors.
2.2 Payment
Payment is required at the time of checkout. ICEBUM accepts payment methods as listed on its website.
3. Liability and Disclaimer
3.1 Use at Your Own Risk
Use of the Floating Bar is at your own risk. ICEBUM shall not be liable for injuries, damages, losses, or accidents arising from use of the product including but not limited to slips, falls, drowning, or property damage.
3.2 Beverage Responsibility
ICEBUM assumes no responsibility for health risks, injuries, or consequences resulting from the storage or consumption of beverages placed in the Floating Bar.
4. Intellectual Property
4.1 Ownership
All content, designs, logos, trademarks, product designs, and materials related to the Floating Bar are the property of ICEBUM and are protected by applicable intellectual property laws. Use of the Floating Bar does not grant any license or rights to ICEBUM intellectual property except as expressly authorized in writing.
4.2 Prohibition on Reverse Engineering
You may not disassemble, decompile, modify, reverse engineer, or attempt to replicate the Floating Bar or any of its components. Any such actions constitute a violation of these Terms and may result in legal action.
5. Limited Warranty
ICEBUM provides a limited three year warranty on the Floating Bar beginning from the original date of purchase.
5.1 Warranty Coverage
ICEBUM warrants that the Floating Bar will be free from defects in materials and workmanship under normal and intended use for a period of three years from the original purchase date. This warranty applies only to the original purchaser and requires proof of purchase from ICEBUM or an authorized ICEBUM dealer.
5.2 Remedies
If a covered defect is confirmed, ICEBUM will at its sole discretion repair the product, replace the product, or replace defective components. Replacement products or components may be new or refurbished.
5.3 Exclusions
This warranty does not cover damage resulting from misuse, abuse, neglect, improper installation, unauthorized modification, accidents, impacts, environmental exposure beyond intended use, or use outside the intended purpose of the Floating Bar. Normal wear and tear and cosmetic damage that does not affect functionality are not covered.
5.4 Warranty Claims
All warranty claims must be submitted directly to ICEBUM through the warranty process available on the ICEBUM website. ICEBUM may require photos, videos, or return of the product for inspection prior to approving a claim.
5.5 Shipping and Costs
Customers may be responsible for shipping costs associated with warranty evaluation unless otherwise determined by ICEBUM. ICEBUM will cover shipping costs for approved warranty replacements.
5.6 No Additional Warranties
This limited warranty is the sole warranty provided by ICEBUM. No dealer, reseller, or representative is authorized to modify or extend this warranty or make additional warranties on behalf of ICEBUM.
5.7 Limitation of Liability
To the maximum extent permitted by law, ICEBUM shall not be liable for incidental, indirect, or consequential damages arising from the use or inability to use the Floating Bar.
6. Modifications to Terms and Policies
ICEBUM reserves the right to update, modify, or change these Terms of Service, warranty terms, or related policies from time to time. Any changes will be effective upon posting the revised Terms on the ICEBUM website. Continued use of the Floating Bar after changes are posted constitutes acceptance of the updated Terms.
7. Governing Law
These Terms shall be governed by and construed in accordance with applicable laws without regard to conflict of law principles.
